DEFINITIONS Activities: Skateboarding, sports, fitness, physical activities, and any related activities organised or facilitated by Skate Tech. Skate Coach: The skateboarding coach allocated for the lesson by Skate Tech. Participant: The individual participating in the Activities. Parent/Guardian: The legal guardian or parent of the Participant, where applicable. Assumption of Risk: Acknowledgment that skateboarding and related Activities carry inherent risks, including serious injury, death, or property damage, and that participation is voluntary with full acceptance of these risks. Exclusion of Liability: Removal of Skate Tech’s responsibility for any harm, injury, or damage caused during participation in the Activities, as permitted by law. Release of Liability: Voluntary relinquishment of any claims or legal rights against Skate Tech, its officers, employees, contractors, and other parties involved in providing the Activities, for any injuries, damages, or losses incurred during participation. Indemnity: Agreement by the Participant or Parent/Guardian to cover any claims, demands, or legal proceedings brought against Skate Tech arising from participation in the Activities. Personal Insurance: Responsibility of the Participant or Parent/Guardian to obtain and maintain personal accident, medical, or life insurance coverage, as it is not provided by Skate Tech. Media: Photos, videos, or other visual or audio recordings captured during the Participant’s involvement in the Activities. Media Consent: Permission for Skate Tech to capture, use, and publish media featuring the Participant for promotional and marketing purposes. Agreement Scope: The full terms outlined in this waiver, which replace any prior agreements or discussions between the parties, governed by the laws of New South Wales. Legal Disputes: Any legal conflicts or disputes related to this agreement, to be resolved by the courts of New South Wales, Australia. WAIVER Assumption of Risk: Before participating in the Activities, you must understand and acknowledge that skateboarding is inherently dangerous and carries the risk of serious personal injury, death, or property damage. By voluntarily participating in the Activities, you accept and assume all risks associated with it. Parent/Guardian Responsibility: If you are signing this document as a Parent/Guardian, you confirm that you have explained the risks associated with the Activities to the Participant. By agreeing to these terms on behalf of the Participant, you warrant that you are their parent or legal guardian and have the authority to enter into this agreement. Exclusion of Liability: To the extent permitted by law, Skate Coach's liability for any death, physical or mental injury, disease contraction or aggravation, or any other harmful or disadvantageous condition arising from the supply of recreational services or Activities is excluded. Additionally, any express or implied warranty or term regarding the provision of Activities with reasonable care and skill is excluded. Release of Liability: By participating in the Activities, you release Skate Coach, its officers, employees, contractors, organizers, sponsors, other participants, and any other involved parties from any demand, claim, or proceeding related to injury, death, or loss or damage to personal property, regardless of the negligence of any released party. You also release Skate Coach from any liability for failure to comply with any express or implied warranty or guarantee regarding the provision of Activities with reasonable care and skill. Indemnity: You agree to indemnify Skate Coach against any demand, claim, or proceeding brought in connection with your participation in the Activities. Personal Insurance: You acknowledge that the fees for the Activities do not include personal accident insurance. Therefore, you are responsible for your own personal accident, medical, and/or life insurance coverage and any associated expenses in the event of injury or death. Fitness and Protective Gear: You must be medically and physically fit to participate in the Activities. You confirm that you have no injuries, physical restrictions, disabilities, or pre-existing conditions that may affect your participation. It is mandatory to wear essential protective gear, including helmets, throughout the lesson. Media Consent: Skate Coach may capture photos or videos during your participation in the Activities. Consent: By participating, you consent to the use of media featuring you for publication on Skate Coach's website, marketing materials, and other selected platforms. Media Ownership: You assign and transfer all rights, titles, and interests, including intellectual property rights, in and to the media to Skate Coach. Release and Indemnity: You release Skate Coach from any claims, actions, demands, or liabilities related to the creation and usage of media featuring you. Agreement Scope & Legal Framework: This document outlines the full agreement between the parties, replacing any previous conversations or agreements. It is governed by the laws of New South Wales, and any disputes will be managed under New South Wales law. Legal Disputes: Both parties agree that the courts in New South Wales will handle any legal issues related to this agreement. No objections will be raised to this location for any legal matters. Additional Actions Required: Both parties commit to taking any further steps and signing any documents necessary to ensure the agreement is fully implemented.
